The woman claiming he is the father of her baby might be trying to get him to take another DNA test, but Justin Bieber is just doing what he does best. 

The 17-year-old took to the stage to perform at the Rockefeller Center in New York today in front of hordes of screaming fans. 

And it seemed Justin wanted to treat his fans to a little Holiday surprise and was joined on stage by Usher and Busta Rhymes as they filmed the lighting of the Christmas tree in the city.

The Mistletoe and wrapped up against the elements in a black leather jacket with gold button and zip detailing.

But despite the chilly temperatures Justin still managed to put on an energetic performance and the crowd pandered to his every note. 

He tweeted: ‘that was a great day....HAPPY HOLIDAYS EVERYONE!!’

While Justin is carrying on with his life as a pop sensation,

the woman claiming that he is the father of her child is said to be asking for the singer to take a second paternity test.

According to the NYDailynews.com Mariah Yeater’s lawyer is requesting that the singer take another test, one where she is present.

The website reports that her lawyer Jeffery Leving said that the single mother deserves the right to meet with the singer and be present when he gets swabbed. 

He told the news site: ‘I want a new DNA test with both sides together at a lab in California as soon as possible. soon as I tell her to do it, she’ll do it. We need proper protocol and a chain of custody.’

It has also been reported that he is speaking with Bieber’s lawyer Howard Weitzman.

and the  pair performed a stellar set despite

Weitzman repeatedly has refused to comment on the claims.

A spokesperson for Justin told MailOnline: 'Justin has taken the test. There is currently no case pending against him and there's been zero evidence supporting this claim.'

Justin has already taken one DNA test to prove he is not the father of a fan's baby.

In an interview with US chat show host David Letterman, Bieber confirmed that he had taken the test, adding 'they just swab your mouth.'

Bieber said he could 'smell a weasel' about the allegations.

'It's pretty crazy [that] people make up false accusations,' said Bieber.

'It's going to happen. Being in the spotlight, people can say whatever.'

The star continued his promotional duties on the Today show this morning, where he performed his Under The Mistletoe (in a  $1,650 festive jacket by Junya Watanabe, no less).

While Yeater was said to be willing to submit her baby for testing there was some suggestion that she was trying to avoid being tested, Attorney Jeffrey Leving told website TMZ that she can't wait to compare baby Tristyn's DNA with Justin's.

But Leving added that he has a big problem with the DNA test Justin has already taken, because a member of Yeater's team was not present while it was administered and he has no idea if the test was done using proper controls.

TMZ reported that Bieber took the DNA test on Friday under 'very controlled circumstances.'

The Canadian singer, who took the DNA test in New Jersey on Friday - and told the David Letterman show last night how it was a simple process in which he had his mouth swabbed.

He again protested his innocence, telling Letterman: 'I mean I could smell a weasel. People make up false accusations.'

The singer went on: 'I am 17, but it is going to happen….Being in the spotlight.  I took it. They just swab your mouth.'

On Monday he looked pretty relaxed and confident after the test as he stepped out with girlfriend Selena Gomez.

The young couple went out for brunch at IHOP in Los Angeles.

Yeater has dropped her lawsuit against the teen star although her lawyer has claimed they plan to pursue the matter privately.

However Bieber has no intention of giving her any form of settlement, and has previously said he was willing to take the test to end the speculation.
